The forms create private case records without publishing a personal name, direct email address or residential address.
1. Roles and contracting parties
Unless Newsycle is expressly named as seller, the buyer contracts with the seller shown at checkout for the product. Newsycle supplies platform, order, payment-routing and support functions. The parties cannot misdescribe those roles to avoid responsibility.
Sellers must provide accurate legal, contact, tax and fulfilment information. Buyers must provide accurate account, order and delivery information. Neither may impersonate another person or conceal the true supplier or controller of a shop.
2. Seller readiness and checkout gates
Paid checkout may remain unavailable until seller identity, connected-payment capability, product status, inventory, required policies, price and delivery data, sandbox qualification and operational controls are complete.
An expression of interest records interest only and takes no payment. A pre-order requires an expressly enabled and disclosed flow. A feature flag or database record alone is not authority to charge.
3. Listings and price integrity
Listings must identify the seller, product, condition, variant, stock position, dispatch estimate, delivery limits, total price, mandatory charges and whether the offer is in stock, made-to-order, a pre-order or an expression of interest.
Drip pricing, false comparison prices, fake urgency or scarcity, hidden mandatory fees and misleading origin, environmental, health or performance claims are prohibited. The total minimum payable must be clear before commitment.
4. Ranking, advertising and reviews
Search and discovery may use relevance, recency, reader choices, availability, quality, seller status and paid placement signals. Paid placement is labelled and does not buy an editorial conclusion. Newsycle may change ranking systems without selling a promise of permanent placement.
Reviews, ratings, follows, sales, testimonials and engagement must be genuine. A material incentive, affiliation or conflict must be disclosed. Newsycle may reject or annotate manipulated or non-experience reviews while preserving a review route.
5. Payments and durable records
Enabled payments use the disclosed provider. A browser success page does not prove settlement. Signed provider events and the durable order record determine authorised, paid, failed, refunded, disputed, cancelled and payout states.
Buyers must not seek duplicate reimbursement for the same loss. Sellers must not submit altered or misleading evidence. Newsycle may pause checkout or settlement where reasonably necessary for fraud, identity, dispute or legal review, subject to provider terms and law.
6. Product safety and fulfilment
Sellers must comply with bans, mandatory standards, warnings and recalls and must honour accepted orders. Newsycle may screen, remove or block relisting of unsafe or recalled products and may notify affected buyers or authorities where appropriate.
A pause in new sales does not erase accepted orders. Sellers must communicate material delays, preserve tracking and stock evidence, and provide remedies required by law and the accepted terms.
7. Returns, disputes and evidence
Buyers should use the order record and provide relevant evidence without sending full payment credentials. Sellers must handle consumer remedies and respond with accurate records. Tracking, a delivery scan or a platform decision does not conclusively determine every dispute.
Newsycle may facilitate communication, preserve evidence and apply platform controls but does not replace a seller, payment provider, court, tribunal or regulator. Internal review does not remove Australian Consumer Law rights or require private arbitration.
8. Enforcement and appeals
Newsycle may reject, pause or remove listings and restrict buying or selling for safety, fraud, prohibited products, rights infringement, manipulation, repeated non-fulfilment or material policy breaches. The response should be proportionate to severity, recurrence and risk.
Where lawful and practical, a material action includes the main reason and a review route. Evasion, evidence destruction or retaliation can lead to further restriction. A report alone is not a final finding.
9. Records, cooperation and legal requests
Sellers and buyers must preserve records relevant to active orders, returns, recalls, disputes and legal obligations. Newsycle may preserve and disclose information where reasonably required for safety, tax, fraud prevention, dispute resolution or a valid legal request, subject to privacy obligations.
Marketplace access across borders is not a promise that a product may be sold or imported everywhere. Sellers are responsible for offering only where lawful; buyers remain responsible for disclosed lawful import conditions that do not shift a supplier’s non-excludable duties.
