Seller agreement

1. Eligibility, authority and seller identity

Only an approved creator or authorised organisation may operate a shop. The operator must have capacity and authority to enter this agreement, provide accurate legal name, business and contact details, complete required identity and connected-payment verification, and keep authorised team roles current.

The seller name displayed at checkout is the supplier of the goods unless Newsycle is expressly identified as seller. Verification confirms completion of a platform process; it is not certification that every product or claim is lawful, safe or accurate.

Do not conceal an overseas supplier, drop-shipping arrangement, manufacturer, product origin or person controlling the shop where that omission would mislead a buyer or prevent lawful contact and remedies.

2. Listings and truthful claims

Each listing must accurately state the product, material characteristics, condition, variant, quantity, total product price, available stock, seller, dispatch estimate, delivery locations, shipping charge, applicable tax and material restrictions. Clearly distinguish in-stock items, made-to-order items, pre-orders and expressions of interest.

Do not fabricate reviews, ratings, sales, endorsements, urgency, scarcity, comparison prices or delivery evidence. Health, performance, environmental, ethical sourcing, country-of-origin and other objective claims must be specific and substantiated before publication.

Use only names, designs, images, trademarks and descriptions you are authorised to use. A platform template, approval or automated check does not transfer responsibility for the listing to Newsycle.

3. Product safety, standards and recalls

Sellers must supply products that comply with applicable bans, mandatory safety and information standards, labelling, packaging, warnings, electrical rules and recall obligations in every place offered. Sellers must monitor official recalls and promptly remove affected stock.

If a product is or may be unsafe, non-compliant or recalled, immediately stop sales, notify Newsycle, identify affected orders, preserve traceability records and cooperate with buyer notice, collection and remedies. Make any mandatory regulator or Minister notification within the statutory period, including the two-day period that can apply to a voluntary consumer-product recall.

Newsycle may remove a listing, pause checkout or notify affected users or authorities where reasonably necessary for safety. Seller responsibility for a recall, remedy or lawful reporting continues after delisting or account closure.

4. Plans, platform fees and processing charges

A verified free shop allows up to five active products, no listing fee and a 3% platform fee. Creator & Storefront is AUD $25 per month total including Member benefits and applies a 1% platform fee. Percentage platform fees apply to merchandise value after seller-funded discounts; shipping and tax are excluded.

Payment processing, currency conversion, dispute, chargeback, tax or connected-account charges are separate only if disclosed before activation or imposed under the payment provider’s accepted terms. Newsycle will not retrospectively increase a fee on an accepted order.

Plan and fee changes apply prospectively after clear notice. The seller may cancel future plan renewal without a cancellation fee. Cancellation does not remove fees already earned on accepted transactions or consumer obligations.

5. Orders, payment and fulfilment

Use the enabled Newsycle checkout and the connected payment account for the correct seller. Do not redirect a buyer off-platform to evade a fee, restriction, safety control or transaction record. A provider success screen alone does not prove settled payment; signed provider events and the durable order record control.

Accepting an order creates fulfilment and consumer obligations. Reserve stock accurately, dispatch within the promised period, use appropriate packaging, provide valid tracking where offered and communicate a material delay promptly. If supply becomes impossible, stop further sales and offer the remedy required by law and the accepted terms.

Provider verification, reserves, refunds, disputes, fraud review and legal restrictions can delay or reduce settlement. This agreement does not create escrow, an automatic 30-day platform payout hold or staged presale fund releases. Newsycle does not guarantee a settlement date that the provider has not confirmed.

6. Taxes, invoices and records

The seller is responsible for determining registration, GST, income, customs, import, invoice and record-keeping obligations applicable to its sales, except where law specifically places an obligation on Newsycle or a payment provider. Supply accurate tax information and do not describe a price as tax-inclusive or tax-exempt without a proper basis.

Newsycle may collect, retain or report seller and transaction information where reasonably required by tax, electronic-platform reporting, payment, fraud or other law. Sellers must keep product, order, consent, dispatch, refund, recall and dispute evidence for applicable retention periods.

7. Returns, disputes and buyer remedies

Honour the Australian Consumer Law and any more generous term offered at purchase. A short change-of-mind window, original-packaging condition, manufacturer warranty or store-credit policy cannot replace statutory remedies for faulty, unsafe, misdescribed or undelivered products.

Respond promptly to return, refund, chargeback and safety requests. Provide accurate evidence; do not alter tracking, communications or order records. If a fault is confirmed, reimburse reasonable return costs where required. Do not seek payment twice or retaliate against a buyer who exercises a lawful right.

Newsycle may facilitate communication and preserve evidence but does not replace the seller’s obligations, the payment provider, a court, tribunal or regulator.

8. Buyer information and communications

Use buyer information only for fulfilment, service, safety notices, lawful records and communication the buyer separately permitted. Do not add buyers or expression-of-interest participants to unrelated marketing, sell their information, use it for another publication, or retain full payment credentials.

Limit team access to people who need it, protect exports, remove access promptly when a role ends and notify Newsycle of suspected misuse or breach. The seller is responsible for its own privacy notices and compliance where it independently controls buyer information.

9. Restriction, responsibility and exit

Newsycle may proportionately reject, pause or remove a listing or restrict selling for safety, verification, fraud, prohibited products, rights infringement, repeated non-fulfilment, unlawful conduct or a material breach. Reasons and a review route are provided where lawful and practical. The seller must not relist around a restriction.

Each party remains responsible to the extent required by law for its own breach, negligence, misleading conduct or unlawful acts. A seller’s obligation concerning third-party claims is limited to loss reasonably arising from the seller’s material breach, unlawful product or infringement and is reduced to the extent Newsycle contributed.

Ending the agreement stops new selling after a reasonable wind-down but does not cancel accepted orders, refunds, recalls, disputes, fees, tax records or privacy duties. Newsycle may retain and disclose records as required for those purposes.
