Terms of use

1. The agreement and policy order

These terms apply between you and LOOKSGOOD.AU PTY LTD trading as Newsycle. The Privacy Policy, Acceptable-use Rules, Copyright Policy and any feature-specific policy linked at the point of use form part of the agreement. Seller, buyer, returns, marketplace, publisher, cookie and editorial policies apply when their subject matter is relevant.

For a specific marketplace order, the checkout record and seller terms accepted before payment supplement these policies. A specific accepted term controls over a general term only for that subject and only to the extent the law permits. Nothing in a later policy retrospectively removes an accrued right or changes an accepted order.

Headings and summaries help navigation but do not replace the operative sections. If any term is invalid or unenforceable, it is read down where lawful and otherwise severed without invalidating the remaining terms.

2. Eligibility, accounts and authority

You must have legal capacity to enter the relevant agreement. A person acting for a company, publication or other organisation confirms that they are authorised to bind it. Age, identity, payment and seller-verification requirements shown for a feature also apply. A person who cannot lawfully consent must not create or operate the relevant account without valid parent, guardian or organisational authority.

Provide accurate and current information, keep authentication methods confidential, use multi-factor or recovery protections when offered and promptly report suspected unauthorised access. You are responsible for activity you authorise, but not for activity caused by Newsycle’s breach or another matter for which the law makes Newsycle responsible.

Do not transfer an account, impersonate another person, conceal the true operator of a publication or shop, or use credentials outside the permissions granted to you. Newsycle may require proportionate verification before restoring access, publishing, selling or paying out funds.

3. Separate reader choices

Free registration, following a publication, following a journalist, saving a story, subscribing to a newsletter, consenting to marketing and buying a membership are separate choices. Following does not create a payment obligation or subscribe you to marketing.

Saved stories and follows belong to the account that created them. Recommendations, rankings, promotions and the following feed must be distinguishable. A recommendation is not an endorsement or a promise that reporting, a creator, a seller or a product is error-free.

4. Content, permissions and licence

You retain ownership of content you submit. You grant Newsycle a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, cache, transmit, display and make technical backup copies only as reasonably necessary to operate, secure and improve the requested service, distribute content through features you enable and display permitted excerpts, thumbnails and previews. Separate uses beyond those purposes require permission.

You must have the rights, consents and lawful basis needed for submitted text, photographs, audio, video, artwork, trademarks, personal information and audience records. Attribution or a link does not itself grant permission. External-source reports remain subject to the named publisher’s rights and access rules.

The licence ends when content is permanently removed, subject to reasonable backup cycles, legal and dispute records, completed transactions and copies already shared outside Newsycle. The licence does not authorise sale of the work to train unrelated third-party models. Suggestions about Newsycle may be used without an obligation to implement them, but confidential information and your underlying intellectual property remain protected.

5. Paid memberships, pricing and cancellation

Before purchase, checkout must identify the supplier, currency, total charge, billing interval, material inclusions and any mandatory tax or fee. Monthly plans are Newsycle Member at AUD $15 and Creator & Storefront at AUD $25 total, including Member benefits, not an extra $25 on top. A displayed plan does not authorise a charge unless checkout is enabled and you expressly confirm it.

A recurring subscription renews at the disclosed interval until cancelled. You may cancel future renewal through account billing or by contacting Newsycle when that control is unavailable. There is no cancellation fee. Ordinary cancellation keeps access until the end of the paid period, without limiting statutory cancellation or refund rights.

Material price or benefit changes require clear advance notice before the affected renewal and a reasonable opportunity to cancel. Newsycle will correct a renewal caused by its failure to process a timely cancellation. Optional add-ons require separate agreement and may not be preselected as a condition of an unrelated purchase.

6. Marketplace, advertising and investigations

The seller identified at marketplace checkout supplies the product unless Newsycle is expressly identified as seller. An expression of interest is not an order and takes no payment. A pre-order must be clearly identified. These terms do not create escrow, an automatic payout hold or staged presale settlement.

Advertising and sponsored material must be identifiable, accurate and lawful. Payment does not buy editorial endorsement, guaranteed sales, favourable coverage or another publication’s subscriber list. Advertisers are not given raw subscriber email addresses through promotion tools.

Investigation votes are advisory. Where offered, the product may limit voting to one eligible member vote. Membership does not buy a predetermined finding, confidential source identities or control over editorial conclusions.

7. Moderation, suspension and appeals

Newsycle may warn, limit distribution, restrict a feature, suspend an account or remove material when reasonably necessary to address unlawful material, serious or repeated policy breaches, product safety, intellectual-property claims, fraud, security risks or valid legal requirements. Action may be immediate where delay would increase harm.

Where lawful and practical, a material decision identifies the affected content or capability, the main reason, the duration or conditions for restoration and a review route. A report or complaint alone does not prove wrongdoing. Newsycle may preserve evidence and consult affected parties, providers or authorities as permitted by law.

You must not evade a restriction through another account or listing. Internal review does not remove court, tribunal, regulator, payment-provider or statutory remedies.

8. Service operation and third parties

Newsycle uses third-party hosting, database, authentication, email, analytics, advertising, delivery and payment services. Their availability and separate terms can affect a function. External sites and publisher services are controlled by their operators, even when linked from Newsycle.

Newsycle takes reasonable care in operating the service but does not promise uninterrupted, permanently available or error-free access, guaranteed discovery, sales or revenue, or that every user statement is accurate. This paragraph does not exclude a guarantee, duty or remedy that cannot lawfully be excluded.

If an event outside reasonable control delays performance, affected obligations resume when reasonably possible. This does not permit Newsycle or a seller to retain money indefinitely for a service or product that cannot be supplied, or remove any remedy required by law.

9. Responsibility and limits

Each party is responsible to the extent required by law for its own breach, negligence, misleading conduct, unlawful material and infringement. A user is not required to indemnify Newsycle for Newsycle’s own fault. To the extent a business user is lawfully required to protect Newsycle from a third-party claim, that obligation is limited to loss reasonably arising from that user’s material breach, unlawful content or infringement and is reduced to the extent Newsycle contributed.

Nothing excludes, restricts or modifies Australian Consumer Law guarantees, privacy rights, liability for fraud, wilful misconduct, personal injury caused by negligence, or another right or liability that cannot lawfully be excluded. There is no blanket no-refunds rule, compulsory store credit, mandatory private arbitration or waiver of statutory remedies.

Where liability may lawfully be limited, any limitation applies only to loss that was not caused by fraud, wilful misconduct or a failure to use reasonable care, and does not override the remedies a consumer is entitled to receive. Users should keep copies of important content and transaction records.

10. Closure, survival and records

You may stop using free services and request account closure. Creators and sellers must first address active orders, subscriptions, disputes, refunds, audience obligations and records they are legally required to keep. Account closure does not instantly erase public content already lawfully syndicated, completed transaction records, unresolved cases, security logs or backups.

Provisions about ownership, licences needed for retained copies, payment obligations, consumer remedies, privacy, evidence, responsibility, governing law and dispute resolution survive to the extent their purpose requires. Closing an account does not waive a claim that arose earlier.

11. Changes, notices and governing law

Newsycle publishes dated editions. Material changes are notified reasonably before they take effect for ongoing paid services, and additional consent is obtained where law requires it. You can stop using free services or cancel future renewal rather than accept a material prospective change. Continued use does not waive non-excludable rights.

Service notices may be delivered in-product or to the current account email. Legal notices and complaints may use the published complaint channel or operator contact. Failure to enforce a term once is not a waiver. You may not assign an account or agreement without consent; Newsycle may transfer the agreement as part of a genuine business reorganisation or sale only with continued protection of accrued rights and personal information.

Victorian and applicable Australian law govern these terms without removing mandatory protections that apply where you live. A competent court or tribunal may hear a dispute. Urgent legal or regulatory remedies do not depend on completing Newsycle’s internal process first.
