Marketplace buyer terms
These terms explain who sells a marketplace product, when an order is formed, how delivery and payment records work, and the rights that continue after checkout.

The forms create private case records without publishing a personal name, direct email address or residential address.
1. Seller and contracting parties
The seller identified at checkout supplies the product and is responsible for the listing, fulfilment and applicable consumer guarantees unless Newsycle is expressly named as seller. Newsycle supplies the platform, payment and support functions described at checkout.
A verified badge or platform listing is not a guarantee that every statement, product or seller is free from error or risk. The seller cannot use Newsycle’s platform role to avoid its obligations, and Newsycle cannot exclude responsibilities the law places on it.
2. Before placing an order
Check the seller, product, condition, variant, quantity, sale mode, delivery address, dispatch estimate, shipping, tax and total payable. Mandatory charges must be disclosed before payment and must not be added after commitment without your express agreement.
An expression of interest takes no money and guarantees neither stock nor price. A pre-order must be clearly labelled with the expected dispatch period and material conditions. Member-only products or discounts require the disclosed current entitlement.
Product images can illustrate appearance but a material variation must be disclosed. Do not rely on an unrecorded promise; ask the seller or Newsycle to confirm a material point through the order channel.
3. Order formation and payment
Submitting checkout is an offer to buy and authorises the disclosed payment attempt. An order is accepted when the seller or platform issues an acceptance or dispatch confirmation, unless checkout clearly states another formation point. Stock or fraud errors may require cancellation and a prompt refund.
A browser success page does not by itself prove settled payment. Signed provider events and the durable order record determine payment status. Do not repeat payment solely because confirmation is delayed; check the order record or contact support.
Keep the confirmation and use a payment method you are authorised to use. Currency conversion or issuer charges are governed by the provider or issuer where clearly disclosed and lawfully applied.
4. Delivery, title and risk
Provide accurate delivery information and promptly correct an error before dispatch where possible. The seller must dispatch within the promised period, communicate material delays and provide the remedy required if it cannot supply.
Title and risk pass only as provided by applicable law and the accepted seller terms; a clause cannot remove statutory rights for lost, damaged, unsafe or undelivered goods. Tracking information is evidence but does not conclusively decide every delivery dispute.
For international delivery, the listing must disclose material location, customs or import restrictions known to the seller. A buyer is responsible for lawful receipt where a disclosed import obligation applies, but not for a hidden mandatory charge.
5. Returns, refunds and cancellations
Australian Consumer Law and other non-excludable rights apply alongside any more generous seller policy. A seller cannot retroactively change accepted terms, insist on store credit instead of a legally required refund, or send a buyer only to the manufacturer.
Use the order return or refund facility or contact support with the order reference and relevant evidence. Do not send a full card number or security code. Refund approval, provider submission and completed credit are different states and may take different amounts of time.
6. Buyer conduct
Do not use false identity or delivery information, misuse another person’s payment method, make a knowingly false claim, manipulate reviews, threaten a seller or seek duplicate reimbursement for the same loss.
A genuine complaint, chargeback or exercise of a statutory right is not prohibited merely because it is disputed. Reviews must reflect a genuine experience and disclose a material incentive or conflict.
7. Support and external remedies
Newsycle may facilitate communication, preserve order evidence and apply platform controls. A platform decision is not a court judgment and does not prevent a lawful payment-provider, consumer affairs, tribunal, court or regulator process.
Use the complaints route if ordinary order support does not resolve the issue. Urgent product-safety concerns should also be reported to the appropriate public authority. Internal review does not waive a limitation period or other statutory right.
